1. Instructions on how to enter the draw and the offer form part of these terms and conditions ("Terms and Conditions"). Participation in this GreenPan x Koala Eco promotion ("Promotion") is deemed acceptance of these Terms and Conditions. This Promotion is not valid in conjunction with any other offer. Entries must comply with these Terms and Conditions to be valid.
 2. The promoter is THE COOKWARE COMPANY AUSTRALIA PTY LIMITED ABN 11 639 575 054 of Level 21, 55 Collins Street, Melbourne VIC 3000 ("Promoter" or "GreenPan").
 3. The Promotion commences at 9:00 am (AEST) on Monday, 16 October 2023, and closes at 11:59 pm (AEST) on Sunday, 12 November 2023 ("Promotional Period"). The Promotional Period may be extended in the sole discretion of the Promoter. Entries received after the Promotional Period will not be accepted.
 4. Participants must submit their Online Entry Form by 11:59pm (AEST) on Sunday, 12 November 2023.
5. To enter the draw, participants must:
 a. Purchase a GreenPan Participating Product from a Participating Retail Store or from www.myer.com.au.
 b. Satisfy the other eligibility and entry requirements in these Terms and Conditions below.
 6. One (1) participant will be drawn at random no later than Thursday, 16 November 2023 and will receive one (1) prize: a year of Koala Eco supply with a total retail value of $1005. Prize is not redeemable for cash or transferable.
7. Participants must spend a minimum of $50 on any GreenPan Participating Product purchased from any Participating Retail Store or on www.myer.com.au to be eligible to enter the draw. Every $50 spent during the promotion period will give participant one (1) right to enter the draw – i.e., spend $50, receive 1 entry, spend $200 receive 4 entries, spend $400 and receive 8 entries, spend $1000 and receive 20 entries.
 A maximum of two participations per household can be made during the promotion.
Definitions
8. For the purposes of these Terms and Conditions:
 a. "Participating Product" means any of the GreenPan cookware products that are being sold in Participating Retail Store or on www.myer.com.au during the promotion duration, that are supplied by GreenPan in Australia and sold directly by GreenPan or by a Participating Retail Store. For clarity, Participating Product does NOT include any "C grade", "seconds", second-hand, refurbished or demonstration products which products are not eligible for the Promotion.
 b. "Participating Retail Store" means any one of the Australian retail stores trading under the following trading names that is authorized by GreenPan to sell Participating Products and has been invited by the Promoter to participate in the Promotion:
 • Myer The Promoter recommends that prior to purchasing a Participating Product, each participant verify with the retailer that it is a Participating Retail Store.
 c. “Proof of Purchase” means an original tax invoice clearly confirming a Purchase. The Proof of Purchase must clearly specify: - The Participating Product that was purchased. - The price paid for the Participating Product. - The Participating Retail Store in which the Participating Product was purchased (in case of in-store purchase). Or in the case of an online purchase: www.myer.com.au. - The date that the Participating Product was purchased during the Promotional Period and prior to the entry being made.
 d. “Purchase” means making full and final payment for a Participating Product during the Promotional Period. This does not include laybys unless the final layby payment is made during the Promotional Period. Use of services such as Afterpay and Zippay transactions do not constitute Purchases unless payment is made in full during the Promotional Period.
e. “Prize” means a year of Koala Eco supply valued at $1005 and including: 6 x 1L Laundry Wash 1 x Kitchen Cleaner + 3 Concentrated Refills 1 x Bathroom Cleaner + 3 Concentrated Refills 1 x Glass Cleaner + 1 Refill 1 x Dish Soap + 2 Refills 3 x Hand Wash + 4 Refills 6 x Body Wash 500ml 1 x Fruit & Vege Wash + 1 Refill 1 x Floor Cleaner + 2 Refills 2 x Hand Sanitiser 2 x Hand and Surface Spray 2 x Pillow and Linen Spray 2 x Room Spray or in the Promoter’s absolute discretion an alternative Koala Eco product of equivalent value.
Privacy
 9. Entries remain the property of the Promoter. GreenPan and its agents collect personal information in order to conduct the Promotion and may, for this purpose, disclose such information to third parties, including, but not limited to, agents, contractors, service providers, offer suppliers and, as required, to Australian regulatory authorities. Validity of entries is conditional on providing this information. GreenPan and its agents may, for an indefinite period, unless otherwise advised, use the information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning a participant. Participants acknowledge that the information they provide will be collected by or on behalf of GreenPan and may be disclosed to other group companies and to third parties that help GreenPan deliver its products and services (including suppliers, contractors, dealers, agents and business partners) or as required by law. Participants should direct any request to access, update or correct information to GreenPan’s Privacy Officer at customercare@greenpan.com.au. These Terms and Conditions are deemed to incorporate GreenPan’s privacy policy and by entering the Promotion, each participant accepts the terms and conditions of GreenPan’s privacy policy.  Eligibility and entries
 10. To be eligible to enter the draw, each participant must:
 a. be an Australian resident currently living in Australia with an Australian residential and postal address;
 b. be aged 18 years old or over, or if under the age of 18, have obtained the consent of their parent or legal guardian to participate in this Promotion;
 c. be the Participating Product’s end-user, meaning the participant must Purchase the Participating Product for their own use and not for commercial purposes, re-sale, resupply, rental, hire purchase or any other indirect use;
 d. make a Purchase and retain the original Proof of Purchase in respect of that Purchase; visit https://greenpan.com.au/pages/greenpan-myer-contest-102023 ("Website") by, 12 November 2023; and follow all of the prompts and instructions, which may include asking the participant to do any or all of the following:
 - Retain original packaging and Proof of Purchase.
- Visit the https://greenpan.com.au/pages/greenpan-myer-contest-102023 ("Website") and provide:
 • Information including the participant’s full name, contact telephone number, email address, and purchase amount.
 • Upload a picture of the receipt from a Participating Retail Store using a camera, phone, computer webcam or alternatively, by scanning the receipt using a scanner. In the case of an online purchase, upload a screenshot of the order confirmation from www.myer.com.au where the product name, amount, and date of purchase is stated.
 The Promoter and its associated agencies accept no responsibility for lost, stolen, late, damaged or misdirected entries. Participants must ensure that all personal details provided are correct. GreenPan will not retain online receipts or accompanying documentation.
Validation of entries
 11. The Promoter will:
 a. ensure that the purchase amount matches the number of entries per participant.
b. ensure that the Proof of Purchase submitted by each participant is valid.
 12. Once a participant’s entry has been validated, the Promoter will add his/her name into the draw.
Draw
13. One (1) winner will be randomly selected by a computer-generated random selection programme. The person selected will be contacted by the Promoter directly and at that time may ask to see and verify the receipt of the purchase of Participating Products. This random selection and announcement will happen no later than the 16 November 2023.
The Promoter reserves the right to accept or decline any entry if the proof of purchase cannot be definitively confirmed.
If the Promoter cannot contact a winner within 48 hours and all reasonable attempts – via phone & email have been attempted, the Promoter will re-draw that person’s place in the Competition.
Prize
 14. All entrants go in the draw to win one (1) year of Koala Eco supply valued at $1005 (“Prize”).
 15. The Prize will be delivered to the winner directly by Koala Eco, but may be subject to delivery and/or processing delays.
 16. The Prize will be received via redemption. Change of delivery address requires 30 calendar days’ notice by contacting customercare@greenpan.com.au. If a delivery has already been dispatched before any change of delivery address is notified winner may not receive the delivery and GreenPan and Koala Eco will not be liable for the delivery. Winner may not delay any delivery or change any aspect of the delivery including contents of the Prize pack.
 17. GreenPan and Koala Eco are not responsible for delivering Prize to the winner, or any delivery or processing delays. GreenPan and Koala Eco will endeavor to arrange the Prize delivery within 28 business days of the notification email.
 Invalid entries
18. The Promoter will only despatch the Prize to an Australian address. The Promoter will despatch the Prize to the address in Australia provided by the Winner.
19. GreenPan and Koala Eco have no responsibility if the Winner provides an incorrect address or is not available to accept the delivery. Risk in the Prize passes to the Winner when GreenPan and Koala Eco despatch the Prize via its chosen delivery method.
 20. In the event that GreenPan determines in its sole discretion that the Winner has provided an invalid Proof of Participating Product and/or Proof of Purchase, the Winner will be notified via the email address ("Notification Email") provided by the Winner of the reason for this determination. The Winner will have until 11:59 pm (AEST) on the fourteenth (14th) calendar day after the Notification Email is sent to provide a valid Proof of Participating Product and/or Proof of Purchase, as applicable, by responding to the Notification Email.
 21. The Promoter may invalidate an entry if a participant fails to provide a valid Proof of Participating Product and/or Proof of Purchase by the fourteenth (14th) calendar day after the Notification Email is sent.
 22. The Promoter may, at any time, verify the validity of entries and participants (including a participant's identity, age and place of residence, Proof of Purchase and Proof of Participating Product provided as part of an entry) and to disqualify any participant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. All decisions of the Promoter are final and no correspondence will be entered into. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
23. Incomplete, indecipherable or illegible entries will be deemed invalid. Participants are responsible for ensuring their correct contact email address and other details are provided and any updated details are notified to the Promoter. The Promoter accepts no responsibility should a participant fail to notify the Promoter of correct details or of a change to those details, or for otherwise providing incorrect information.
General
 24. If a Participating Product, details of which are submitted as part of an entry, is returned for a refund or exchange, that entry is disqualified from the Promotion and the participant is not entitled to enter the draw.
 25. Any costs associated with this Promotion and entering the draw is each participant’s responsibility. All taxes (excluding GST) which may be payable as a consequence of receiving the Prize is the sole responsibility of the winner. All other ancillary costs including but not limited insurance, taxes (excluding GST) and any and all other expenses are the responsibility of the winner. The Promoter makes no guarantee of the availability of its web services and will not be held responsible for any interruption of service that may interfere with the participant’s ability to participate in this Promotion.
 26. Subject to these Terms and Conditions and to the maximum extent permitted by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence) for any personal injury, or any loss or damage (including loss of opportunity), whether direct, indirect, special or consequential, arising in any way out of the Promotion, including, but not limited to, where arising out of the following:
 a. any technical difficulties or equipment malfunction (whether or not under the Promoter's control);
 b. acts or omissions (including negligent acts or omissions) of the Promoter's employees or agents involved in the conduct of this Promotion.
 c. any theft, unauthorized access or third party interference;
 d. any original Purchase documentation that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter;
 e. any tax or other financial liability incurred by a participant.
 27. GreenPan is not liable for any failure to fulfil this offer where such failure is caused by any supervening circumstances amounting to Force Majeure, being something which is beyond GreenPan’s reasonable control and/or events which, without the fault of GreenPan, render performance impossible or incapable of satisfactory execution.
28. GreenPan reserves the right to withdraw this promotion at any time without incurring any liability.
29. GreenPan does not warrant that its website is free from viruses or bugs and is not responsible for any loss of content or material uploaded or transmitted through its website.
30. Nothing in these Terms and Conditions is intended to exclude, restrict or modify any consumer rights under the Competition and Consumer Act 2010 (Cth) ("CCA") or any other legislation that may not be excluded, restricted or modified by agreement. If the CCA or any other legislation implies a condition, warranty or term into the Terms and Conditions or provides statutory guarantees in connection with these Terms and Conditions, in respect of goods and services supplied (if any), the Promoter's liability for breach of such a condition, warranty, other term or guarantee is limited to (at the Promoter's election), to the extent it is able to do so:
 a. in the case of supply of goods, the Promoter doing any one or more of the following: - replacing the goods or supplying equivalent goods; - repairing the goods; - paying the cost of replacing the goods or of acquiring equivalent goods; and/or - paying the cost of having the goods repaired; or
 b. in the case of supply of services, the Promoter doing either or both of the following: - supplying the services again; and/or - paying the cost of having the services supplied again.
 31. These Terms and Conditions are governed by the laws of Victoria. Participants submit to the non-exclusive jurisdiction of the courts of Victoria.
